Terms of Service
Effective date: October 21, 2026. Replaces the Terms of Use dated July 15, 2026.
1. Who we are and acceptance of these Terms
HuddleShift is operated by Mert Balcı, Nispetiye Mahallesi Petrol Sitesi Sokak 24. Blok 1AI Daire 6, Beşiktaş, İstanbul, Türkiye, trading as HuddleShift. When you use HuddleShift, your contract is with Mert Balcı.
These Terms cover the HuddleShift website, mobile apps and web app, and the services they provide: shift scheduling, GPS-verified clock-in/out, leave requests, shift swaps, team communication and AI features (the Services). By creating an account, accessing or continuing to use the Services, you agree to these Terms and to our Privacy Policy, which forms part of them. If you use the Services on behalf of a business, you confirm you are authorised to bind that business. If you do not agree, stop using the Services.
2. Accounts
Managers create a workspace and invite employees. You must be at least 18 to create a manager account. You are responsible for keeping login details secure and for all activity under your account.
3. Orders, payment, subscriptions and trial
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to payments and handles returns.
Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Prices, taxes, billing, renewals and cancellations for purchases made on our website are governed by Paddle's Buyer Terms. Purchases made inside our iOS or Android app are processed by Apple or Google under their own terms. Refunds are described in our Refund Policy.
New managers receive a 14-day trial of Pro features without a payment card. When the trial ends, the workspace moves to the Free plan unless a paid plan is purchased. Data beyond the Free plan limits is kept but frozen, not deleted.
4. License and its limits
We grant you a personal, non-transferable, non-exclusive and limited license to use the Services for your internal business operations, in line with your plan. This license transfers no ownership. We may modify, suspend or withdraw features or content of the Services; termination of access is governed by Section 13.
5. Acceptable use
You must not:
- use the Services for any unlawful purpose, including breaches of employment, data protection or privacy law;
- commit fraud, send spam, impersonate other users or access accounts you are not authorised to use;
- infringe anyone's intellectual property or other rights;
- introduce viruses or malware, probe or test the security of the Services, or disrupt the app or servers;
- reverse engineer the Services or attempt to access their source code;
- use bots, scrapers or other automated tools to access or collect data from the Services;
- collect, publish or process other people's personal data without their consent or another lawful basis, or harass or threaten anyone.
6. User content and responsibility
You are responsible for all content you upload or enter, including schedules, staff data and working hours (User Content). You warrant that your User Content does not infringe third-party rights and that you have obtained all legally required permissions and consents, in particular for your employees' personal data and location data. You keep all rights in your User Content and grant us the rights needed to host, process and display it to provide the Services. You are responsible for keeping your own backups.
7. AI features
The Services include AI features, including the HuddleShift AI Scheduler and the Hadger AI Assistant (AI Features), which generate schedules, suggestions and answers from the information you provide (Outputs).
- Your responsibility. You are responsible for the prompts, schedule photos and other inputs you submit, for having the right to submit them, and for how you use Outputs.
- Accuracy. Outputs may be incomplete or wrong. Review every AI-generated schedule before publishing it to your team. Outputs are not legal, payroll, tax or employment-law advice; you remain responsible for complying with labour law, working-time rules and employment contracts.
- Prohibited AI use. You must not use AI Features to create illegal content, non-consensual sexual content or deepfakes, hateful or harassing content, malware, deceptive content or content that exposes people's personal data, and you must not try to bypass their safeguards.
- Ownership. As between you and us, you own your inputs and the Outputs generated for your workspace, subject to these Terms.
- Moderation and takedown. We may review, restrict or remove content we reasonably believe breaks these Terms. To report content that infringes your rights, contact support@huddleshift.com.
8. Intellectual property
All content of the Services, including software, designs, text, logos and the HuddleShift name, belongs to Mert Balcı or his licensors. You may not copy, distribute, reverse engineer or commercially use it without our written permission.
9. Cookies and tracking
We use cookies and similar technologies to improve your experience, keep the Services secure and remember your preferences. You can disable cookies in your browser, but some features may not work fully. See our Privacy Policy.
10. Service availability and disclaimer
The Services are provided as is and as available. We do not guarantee that they will be uninterrupted, error-free or free from attacks, or that GPS verification will always be exact.
11. Limitation of liability
To the extent permitted by law, including Article 115 of the Turkish Code of Obligations, HuddleShift, Mert Balcı and his employees are not liable for service interruptions, data loss, deviations in GPS verification, or loss of labour, profit or business. Our total liability is limited to the subscription fees you paid in the three months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory consumer rights.
12. Indemnification
You agree to indemnify and hold harmless HuddleShift, Mert Balcı and his employees against all claims, losses and legal costs, including reasonable attorney's fees, arising from your breach of these Terms, your misuse of the Services or your User Content.
13. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate these Terms. Where reasonable, we will give notice first. You may stop using the Services and delete your account at any time. Cancelling a paid plan takes effect at the end of the current billing period.
14. Force majeure
We are not liable for failure to perform caused by events beyond our reasonable control, such as natural disasters, war, government decisions or large-scale telecommunications outages, and we may suspend the Services during such events.
15. Changes to these Terms
We may update these Terms. We will post the new version on this page and notify managers of material changes by email or in the app. Continued use after the effective date means you accept the updated Terms.
16. Severability
If any provision is found invalid, it will be limited to the minimum extent necessary or removed, and the remaining provisions stay in force.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction, without affecting any mandatory rights you have as a consumer under the laws of your country of residence.
